These Terms and Conditions govern your use of Octavisualizer, a product of Octathorpe Technologies (SMC-Private) Limited ("we", "us", "our"), a company registered in Pakistan. By using our platform you agree to these terms.

1. About Octavisualizer

Octavisualizer is a 3D product visualization platform that enables ecommerce merchants to display interactive 3D models of their products on their online stores. The platform includes a 3D viewer, a product configurator, and an order management system.

2. Merchant accounts

To use Octavisualizer you must create a merchant account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. Services and fees

Octavisualizer offers services including 3D model production, viewer integration and monthly hosting subscriptions. Fees are as agreed in your individual service agreement or invoice. We reserve the right to update pricing with reasonable advance notice.

4. Payment

Fees and payment arrangements are stated in the applicable proposal, service agreement or invoice. All prices are displayed in USD unless otherwise stated. Monthly subscription fees are billed on the agreed billing date using the payment method communicated to the merchant.

5. Intellectual property

All 3D models, viewer technology, configurator software and platform infrastructure created by Octathorpe Technologies (SMC-Private) Limited remain our exclusive intellectual property. Merchants are granted a non-exclusive license to use the models and viewer on their store for the duration of their active subscription. This license terminates upon cancellation or non-payment.

Product photographs and brand assets provided by merchants remain the merchant's property. We use these solely to produce the agreed 3D deliverables.

6. Acceptable use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to reverse engineer, copy or resell our technology
• Interfere with the platform's operation or security
• Use the platform to sell counterfeit or prohibited goods

7. Availability and uptime

We aim to maintain high platform availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from temporary unavailability.

8. Limitation of liability

To the fullest extent permitted by law, Octathorpe Technologies (SMC-Private) Limited shall not be liable for any indirect, incidental or consequential damages arising from your use of the platform. Our total liability in any circumstance shall not exceed the amount you paid us in the preceding 3 months.

9. Termination

Either party may terminate the service agreement with written notice as specified in the individual service contract. Upon termination, your access to the platform will be suspended and 3D models will no longer be served on your store. Outstanding payments remain due.

10. Governing law

These terms are governed by the laws of Pakistan. Any disputes shall be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Karachi, Pakistan.

11. Changes to these terms

We may update these Terms and Conditions from time to time. Continued use of the platform after changes constitutes acceptance. Material changes will be communicated by email.
